What Family Court Fees Will I Pay?

When you apply to the Family Court (higher jurisdiction) or Federal Circuit Court (lower jurisdiction where most family law proceedings take place) for family law proceedings, you should be aware that there are court fees.


In some cases, the total court fees will be hundreds or thousands of dollars depending on your circumstances, the court your proceedings are heard in and how long proceedings run for.

 

Family Law Court Fees and Hardship Relief

If you:

  • have a health care card or low-income card;

  • have a pensioner concession card;

  • have a Commonwealth seniors health card;

  • have a card issued by the Department of Human Services or the Department of Veterans’ Affairs that shows your entitlement to health concessions;

  • are an inmate of a prison or otherwise legally detained in a public institution; or

  • can otherwise show you are in financial hardship;

you may be exempt from court fees or in the case of a divorce, there is a reduced fee.

Yearly Court Fee Increases

Family law court fees increase on 1 July of each year, so you can save some money if you file on or before the end of the current financial year.


Who Pays the Court Fees?

The person who initiates family law court proceedings will almost always pay the highest court fees. The person who responds to court proceedings will also have some fees, however, these will be lower than the person who initiates proceedings.

 

Federal Circuit Court - Court Fees for Family Law Proceedings

If you initiate or respond to family law proceedings in the Federal Circuit Court you can expect to pay the following court fees, however, if your matter settles early the fees will be less or if your matter requires the issue of subpoena, an interim application\hearing or further trial days, the court fees will be more.


Initiating Proceedings

Initiating application (property or parenting) with final orders $365.00.

Initiating application (property or parenting) with interim and final orders $490.00.

Initiating application (both property and parenting) with final orders $595.00.

Initiating application (both property and parenting) with interim and final orders $720.00.

Responding to Proceedings

Response with final orders $365.

Interim Application\Hearing

Interim order application or an application in a case $125.00.

Final Trial

Setting down fee for a final hearing (non-refundable) $660.00.

Daily hearing fee (for each day after the first day) $660.00.

Other Court Fees

To issue each subpoena $55.00.

Financial conciliation conference fee $415.00 (property settlement proceedings only).


What is The Total Federal Circuit Court Fees I Will Pay?


Court Fees to Initiate Property Settlement Proceedings in the Federal Circuit Court

If you initiate property settlement proceedings with interim and final orders, which went to a one-day final trial, you will pay at least:

  • Initiating application with interim and final orders $490.00.

  • Financial conciliation conference fee $415.00.

  • Setting down fee for a final hearing (non-refundable) $660.00 (plus $660.00 for each day after the first).

The total court fees come to $1,565.00 for a one-day final trial. If the matter settles early, the fees would be lower.


Court Fees to Respond to Property Settlement Proceedings in the Federal Circuit Court

If you respond to property settlement proceedings with interim and final orders, you will pay at least $490.00 in Federal Circuit Court fees.


Court Fees to Initiate Parenting Proceedings in the Federal Circuit Court

If you initiate parenting proceedings with interim and final orders, which went to a one-day final trial, you will pay at least:

  • Initiating application with interim and final orders $490.00.

  • Setting down fee for a final hearing (non-refundable) $660.00 (plus $660.00 for each day after the first).

The total court fees come to $1,150.00 for a one-day final trial. If the matter settles early, the fees would be lower.


Court Fees to Respond to Parenting Proceedings in the Federal Circuit Court

If you respond to parenting proceedings with final orders, you will pay at least $365.00 in Federal Circuit Court fees.


Cost to Initiate Both Parenting & Property Settlement Proceedings in the Federal Circuit Court

If you initiate both property settlement and parenting proceedings with interim and final orders, which went to a one-day final trial, you will pay at least:

  • Initiating application with interim and final orders $720.00.

  • Financial conciliation conference fee $415.00.

  • Setting down fee for a final hearing (non-refundable) $660.00 (plus $660.00 for each day after the first).

The total court fees come to $1,795.00 for a one-day final trial. If the matter settles early, the fees would be lower.


Cost to Respond to Both Parenting & Property Settlement Proceedings in the Federal Circuit Court

If you respond to both property settlement and parenting proceedings with final orders, you will pay at least $365 in Federal Circuit Court fees.


Other Federal Circuit Court Fees You May Incur

Other common court fees include:

  1. The issue of one or more subpoenas that require documents to be provided;

  2. The issue of one or more subpoenas requiring a witness to attend court; or

  3. To seek interim orders or an application in a case that requires a court order or court attention.

  • Setting down fee for a final hearing (non-refundable) $900.00 (plus $900.00 for each day after the first).

The total comes to $1,390.00 in Family Court fees for a one-day final trial. If the matter settles early, the fees would be lower.

If you respond to parenting proceedings with final orders, you will pay at least $465.00 in Family Court fees.


Cost to Initiate Both Parenting & Property Settlement Proceedings in the Family Court

If you initiate both property settlement and parenting proceedings with interim and final orders, which went to a one-day final trial, you will pay at least:

  • Initiating application with interim and final orders $720.00.

  • Financial conciliation conference fee $415.00.

  • Setting down fee for a final hearing (non-refundable) $900.00 (plus $900.00 for each day after the first).

The total comes to $2,035.00 in Family Court fees for a one-day final trial. If the matter settles early, the fees would be lower.

If you are responding to both property settlement and parenting proceedings in the Family Court you can expect to pay at least $365.00.
