Freemont Family Lawyers' divorce lawyers are adept at completing sole divorces. A sole divorce application is where the other party does not agree to complete a joint divorce. A sole divorce application must be served on the other party, usually by hand or post. Our divorce lawyer will take your information, provide you with legal advice about your divorce and the effects of the divorce, and provide critical information you need to know when you are completing your sole divorce application, including: 1. The divorce filing fee. 2. Time limitation periods that start running when your divorce is granted, which may affect property settlement rights. 3. General advice about who gets what out of the divorce. To start your sole divorce application, we suggest obtaining a copy of your marriage certificate (or ordering one from Births, Deaths and Marriages Victoria now: https://www.bdm.vic.gov.au/marriages-and-relationships/get-a-marriage-certificate ). Our Fee Covers: 1. A consultation with an experienced divorce lawyer. 2. Our divorce lawyer will obtain important information about your circumstances and relationship. 3. We will prepare the Sole Application for Divorce and send to you for review. 4. We will file the divorce application with the court. 5. Once filed, we will arrange service of the divorce application on the other party. 6. Once service has been enacted, we will prepare an affidavit of proving signature and affidavit for service and file with the court. Disbursements: Additional fees will apply for: 1. The court filing fee; and 2. Service by hand fee. Additional Costs: 1. There may be additional costs if your divorce application requires extra work. Some circumstances where this can occur are: 2. It may be necessary to prepare and file an additional affidavit with your divorce application, if: a. You cannot provide a marriage certificate. b. An order for substituted service is required because you cannot locate your spouse. c. There are residency or jurisdictional issues. d. There is a change in name or disparity between the legal name and the name on the marriage certificate. e. The parties are separated under the same roof. 3. In some cases, there may be a divorce dispute, such as a dispute about the date of separation or where jurisdiction for a divorce is challenged. 4. Where there are no appropriate arrangements in place for children of the marriage.
